Resolving disputes in a mediated settlement is almost always the preferred method when addressing conflict.

The mediation process, or alternative dispute resolution (ADR) process, generally enables those in dispute to determine a solution that is agreeable to the parties rather than placing the decision making exercise into the hands of an adjudicator who may be restricted or bound to certain limitations.  Accordingly, when parties in dispute attempt to resolve matters, usually through a compromised agreement, the parties remain in control of the outcome.

When assisting in the mediation process, mediators remain impartial and typically refrain from providing opinion or views on the positions taken by the parties whereas the focus on the mediator is to convey positions and assist those in dispute to come to, as best possible, a respectful understanding.
